KVH Industries, Inc., (“KVH”) warrants it's products against defects in materials for following the Warranty Periods:

TracPhone V-IP series: 2 Years Parts & Labor
TracPhone V-/V-IP series and integrated systems: 2 Years Parts & Labor
TracVision Marine (TV- and M-series): 2 Years Parts & 1 Year Labor
IP-MobileCast Media Server: 2 Years Parts & 1 Year Labor
GyroTrac: 2 Years Parts & 1 Year Labor
TracPhone Inmarsat Systems (FleetBroadband and Fleet One): 1 Year Parts & Labor
Sailcomp, DataScope, Azimuth 1000: 1 Year Parts & Labor
TracVision A7, A9: 1 Year Parts & Labor

If you discover a defect in a Product covered by this limited warranty, KVH will, at its option, repair or replace the Product at no charge to you. If KVH, in its sole discretion, determines it is not reasonable to repair or replace the defective Product, KVH may refund to you the purchase price.

This warranty does not apply if the Product has been damaged by accident, abuse, misuse, or misapplication or has been modified without the written permission of KVH; if any KVH serial number has been removed or defaced; or if any factory-sealed part of the system has been opened without authorization. For certain of the Products, failure to pay applicable monthly software maintenance subscription fees relevant to those Products may void the warranty for those Products.

IN NO EVENT SHALL KVH BE LIABLE FOR SPECIAL, PUNITIVE, INCIDENTAL, TORT OR CONSEQUENTIAL DAMAGES OR LOST PROFITS OR GOODWILL (INCLUDING ANY DAMAGES RESULTING FROM LOSS OF USE, DELAY IN DELIVERY OR OTHERWISE) ARISING OUT OF OR IN CONNECTION WITH THE PERFORMANCE OR USE OR POSSESSION OF ANY PRODUCT, OR ANY OTHER OBLIGATIONS RELATING TO THE PRODUCT, EVEN IF KVH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NO IMPLIED WARRANTY: THE EXPRESS WARRANTIES SET FORTH ABOVE ARE THE ONLY WARRANTIES GIVEN BY KVH WITH RESPECT TO ANY PRODUCT FURNISHED HEREUNDER; KVH MAKES NO OTHER WARRANTIES, EXPRESS, IMPLIED OR ARISING BY CUSTOM OR TRADE USAGE, AND SPECIFICALLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR PURPOSE. SAID EXPRESS WARRANTIES SHALL NOT BE ENLARGED OR OTHERWISE AFFECTED BY TECHNICAL OR OTHER ADVICE OR SERVICE PROVIDED BY KVH IN CONNECTION WITH ANY PRODUCT.

Some states/countries do not allow the exclusion or limitation of implied warranties or liability for incidental or consequential damages, so the above limitations may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state/country to state/country.
